02 / Processing of personal data
Introductory provisions
The processing of personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "Regulation") and by Act No. 110/2019 Coll., on personal data processing.
Controller of personal data
The controller of personal data is Jakub Didkovský, Company ID 29706891, with a registered address at Slatina nad Zdobnicí 204, 517 56, Czech Republic (the "controller"). The contact address in all data protection matters is info@didkovsky.cz. The controller has not appointed a data protection officer, as no such obligation arises under Article 37 of the Regulation or any other legal regulation.
Scope and purpose of processing
The controller processes solely the personal data provided by the data subject. Personal data is not obtained from public or commercial databases. The purposes of processing, the categories of personal data processed, the legal bases and the retention periods are set out in the following overview.

Recipients of personal data
The controller does not sell personal data and does not pass it on to third parties for direct marketing purposes. Personal data may be disclosed, to the extent necessary, only to processors ensuring the operation of the controller's services, namely:
- the provider of the email service and the provider of hosting for this website,
- the person or service maintaining the tax records and preparing the tax return,
- public authorities, where a legal regulation so provides.
Personal data is processed within the European Union. Should personal data be transferred to a third country, this shall take place solely on the basis of an adequacy decision of the European Commission under Article 45 of the Regulation or on the basis of standard contractual clauses under Article 46 of the Regulation.
Rights of the data subject
In relation to the processing of personal data, the data subject has in particular the following rights:
- the right of access to personal data under Article 15 of the Regulation,
- the right to rectification of inaccurate and completion of incomplete personal data under Article 16 of the Regulation,
- the right to erasure of personal data under Article 17 of the Regulation,
- the right to restriction of processing under Article 18 of the Regulation,
- the right to data portability under Article 20 of the Regulation, in respect of personal data processed by automated means on the basis of a contract or consent,
- the right to object to processing based on the legitimate interest of the controller under Article 21 of the Regulation,
- the right to withdraw consent under Article 7(3) of the Regulation, without affecting the lawfulness of processing carried out before its withdrawal.
These rights may be exercised at the electronic address info@didkovsky.cz. The controller shall respond without undue delay and no later than one month from receipt of the request.
Right to lodge a complaint with the supervisory authority
Where the data subject considers that the processing of their personal data infringes the Regulation, they have the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, uoou.gov.cz.
Automated decision making
No automated individual decision making or profiling within the meaning of Article 22 of the Regulation takes place.
Nature of the provision of personal data
The provision of personal data through the contact form is voluntary. The data marked as mandatory, namely the name, the electronic address and the content of the message, is necessary in order to deal with the enquiry; if it is not provided, the enquiry cannot be dealt with.
03 / Cookies and analytics tools
The website does not use cookies
The operator does not store cookies in the user's terminal equipment and does not use analytics tools, advertising code or other tracking technologies. For this reason the website contains no consent banner under Section 89(3) of Act No. 127/2005 Coll., on electronic communications.
Stored display mode preference
The only information stored in the browser is the choice between light and dark
display mode, which the user makes themselves using the switch in the header. It is
stored in the browser's local storage under the name jd-theme, contains
only the value "light" or "dark", does not allow the user to be identified and is not
transmitted to the server. This is technical storage strictly necessary for
a service explicitly requested by the user within the meaning of Section 89(3) of
Act No. 127/2005 Coll., for which consent is not required. The user may remove it at
any time by clearing the website data in the browser settings. Until the choice is
made, no data is stored.
The website does not load content from third party servers; fonts, images, styles and the script are stored on the operator's server. The user's IP address is processed solely by the hosting provider in operational logs, for the necessary period and for the purpose of ensuring the security and stability of operation.
Should an analytics tool be deployed, users will first be asked for their consent and this provision will be amended accordingly.
04 / Consumer notice
Information provided before the conclusion of a contract
This website is a presentation and does not allow a contract to be concluded by way of electronic commerce. Submitting the contact form is neither an order nor an offer to conclude a contract, but a non binding enquiry, on the basis of which the operator sends a quotation stating the scope of performance, the price and the delivery date. The contract is concluded when the customer confirms that quotation in writing.
- No prices are stated on the website; the price is determined by the scope of the particular brief. The operator is not registered for VAT, the agreed prices are final.
- The final price, the scope of performance and the delivery date are communicated to the customer in writing before work commences and are binding on both parties.
- The price is paid by way of a deposit and a final payment under the conditions stated in the quotation, always against a proper tax document.
- The work is handed over including the source files; the scope of the licence is set out in Article 05.
Withdrawal from the contract
If the customer is a consumer and the contract was concluded at a distance or away from business premises, they have the right under Section 1829(1) of the Civil Code to withdraw within 14 days of its conclusion. No reason has to be given.
A withdrawal may be sent to the electronic address info@didkovsky.cz or to the registered address of the operator. The model form below may be used, but its use is not mandatory. The deadline is met if the withdrawal is sent no later than on the last day of the period.
The operator begins providing the service within the withdrawal period only on the basis of the consumer's express request. Before that request is made, the operator informs the consumer that, in the event of withdrawal, they will be obliged to pay the proportionate part of the agreed price corresponding to the performance already provided under Section 1834 of the Civil Code, and that if the service is completed in full within that period, the right of withdrawal ceases to exist under Section 1837(a) of the Civil Code.
If the consumer withdraws from the contract, the operator shall return the funds received within 14 days of the withdrawal, using the same means of payment, unless the parties agree otherwise.

Out of court resolution of consumer disputes
Where a dispute arises between the operator and a consumer which cannot be resolved by agreement, the consumer is entitled under Section 20d et seq. of Act No. 634/1992 Coll., on consumer protection, to turn to the body for the out of court resolution of consumer disputes:

Content of the website
The texts, graphic elements, source code and sample brands published on this website are copyrighted works within the meaning of Act No. 121/2000 Coll., the Copyright Act. The user is entitled to display the content and to link to it. Reproduction, distribution, use in the user's own presentation and adaptation of the content are not permitted without the prior written consent of the operator.
Sample brands
The KOŘEN and MODŘÍN brands, together with the addresses, company identification numbers and the names of persons and suppliers stated, are fictitious. They serve as a sample of the scope of the services offered, they are not a delivery made to a particular customer and they are not registered trade marks.
Licence to the work
Upon full payment of the price the customer acquires a licence, unlimited in time and territory, to use the delivered work for the purpose for which it was created, including the source files. The operator reserves the right to present the delivered work as a reference; where the customer excludes such use in writing, the operator shall not present the work as a reference.
Typefaces and photographs
The typefaces used on this website (Archivo, Newsreader) are licensed under the
SIL Open Font License 1.1, which permits commercial use and self hosting; the full
text of the licence is set out in assets/fonts/LICENSE-fonts.txt. The
photographs used in the sample websites are published under the CC0 1.0 licence or
marked as public domain. An overview of them is set out in the
FOTO-ZDROJE.md file of the relevant website.

Accessibility statement
The website was created with regard to the WCAG 2.2 standard at level AA. The
content can be operated from the keyboard, elements have a visible focus indicator,
colour contrasts have been verified, images have text alternatives and animation
honours the system setting prefers-reduced-motion.
Act No. 99/2019 Coll., on the accessibility of websites and mobile applications, does not apply to this website, as its operator is not an obliged entity under that Act. Where a user identifies content that is difficult to read or to operate, they may report this at info@didkovsky.cz.
